AMHP Legal Update

Course Outline:

This course will look at key legal developments in the field of mental health. It will include a round-up of any key cases decided within the past 18 months, as well as any new guidance. During the day delegates will examine challenges they are currently facing, as well as those which are likely to occur in the near to mid-term. Delegates will also have the opportunity to meet and discuss these matters with other AMHPs while achieving a third of their yearly CPD requirement.

This course will look at the white paper on the reform of the Mental Health Act itself and the impact the reform proposals will, if implemented, have on the way we all work, as well as how the decision to delay LPS is likely to affect patients who lack the capacity to consent to physical health treatment.

Key Learning Outcomes:

  • Review developments in case law over the last year.
  • Discuss the impact of the draft Mental Health Bill should it become law.
  • Clarify what the position with LPS is and its impact on mental health patients.
  • Examine the impact of RCRP as it is rolled out across the country.
  • Examine the latest AMHP workforce study and the CQC’s findings in “Monitoring the Mental Health Act”. 
  • Illustrate the interaction between S117 aftercare and CHC funding.
  • Discuss NHS England's guidance on blanket policies for psychiatric wards.
