Course Outline:
This course has been designed for both Chairs and Panel Members who may oversee the conduct of hearings and make decisions regarding internal disciplinary, complaints or regulatory proceedings.
The course will impart an understanding of the law and ethics involved in undertaking a lawful and fair hearing. They will learn how to effectively control proceedings, witnesses and their representatives enabling proper participation by all those in accordance with procedural rules. They will learn how to maintain a balance between assisting those appearing, and the impartiality of the tribunal.
Delegates will be taught the core skills in collective decision-making, and how to make fair, rational and justified decisions based on the relevant law and findings of fact. They will learn how to appropriately participate in the decision-making process, express opinions relevant to the issues, and to consider the opinions and advice of others.

- Natural Justice and the “nine principles of public life”
- Understanding the relevant legal framework, practice and jurisdiction
- Analysis and evaluation of evidence
- The roles and responsibilities of the Chairs and Panel Members at the hearing
- The procedure of conducting and managing a hearing to facilitate a fair and timely outcome
- Handling witnesses and representatives at the hearing, and dealing with inappropriate conduct
- The art of making ‘collective decisions’ including focussed and relevant discussions and majority procedures
- The dynamic dialectical art of decision writing (the funnel of facts issues, analysis and conclusion)
- Reserving and Announcing the decision including explaining the procedure for receiving the written report
